Terms of service

Zyphia PvP ("Zyphia," "we," "us," or "our") operates the Zyphia PvP Minecraft server (the "Server") and zyphiapvp.com (the "Site"). By connecting to the Server, using the Site, or purchasing through our webstore, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Server, the Site, or the webstore.

These Terms apply to all players and visitors. If you are under the age of majority in your jurisdiction, you may use the Server only with the consent and supervision of a parent or guardian, who accepts these Terms on your behalf.

Zyphia PvP is an independent server. It is not affiliated with, endorsed by, or associated with Mojang AB, Microsoft Corporation, or Minecraft. All related trademarks are the property of their respective owners. Your use of Minecraft is also subject to Mojang's own end-user license agreement and usage guidelines.

To play, you must own a valid, legitimately obtained Minecraft account and comply with Mojang's terms. You are responsible for all activity that occurs under your account and for keeping your credentials secure.

You may not use another player's account without authorization, share an account to evade a punishment, or use alternate accounts to circumvent a ban.

Access to the Server is a privilege, not a right. By playing, you agree to follow the server rules published on our Rules page and communicated by staff. Prohibited conduct includes, without limitation:

• Cheating, hacking, exploiting bugs, or using unauthorized client modifications that grant an unfair advantage
• Harassment, hate speech, threats, or other abusive behavior toward players or staff
• Advertising other servers or services, spamming, or scamming other players
• Attempting to disrupt, overload, or gain unauthorized access to the Server or its infrastructure
• Impersonating staff or other players, or misrepresenting your affiliation with Zyphia

We may enforce these rules through warnings, mutes, kicks, temporary bans, or permanent bans at our discretion. Staff decisions are final, and appeals are handled through our Discord.

Purchases made through our store page are processed by our third-party webstore and payment provider, Tebex. All prices are listed in the currency shown at checkout, and you are responsible for any applicable taxes.

Virtual items. Ranks, keys, cosmetics, and other in-game benefits are digital goods licensed to you for use on the Server. They have no real-world monetary value, cannot be exchanged for cash, and are not transferable except as expressly permitted. You do not own them; you hold a limited, revocable license to use them on the Server.

Delivery and availability. We aim to deliver purchased benefits promptly, but we do not guarantee uninterrupted availability of any item or the Server itself. Features, contents, and pricing of packages may change over time.

Chargebacks. Initiating a chargeback or payment dispute rather than contacting us to resolve an issue may result in the loss of purchased benefits and a permanent ban.

Except where required by law, purchases are final and non-refundable. If you believe a purchase was not delivered or was charged in error, contact [email protected] and we will review the matter in good faith. Refunds, where granted, may be accompanied by removal of the associated benefits.

We may suspend or terminate your access to the Server or Site, remove content or virtual items, and refuse service at any time, with or without notice, for conduct that violates these Terms or the server rules or that we reasonably believe is harmful to other players, to Zyphia, or to third parties.

You will not be entitled to a refund of any purchase where access is terminated for a violation of these Terms or the server rules.

The Site, the Server, and their content, including text, graphics, logos, custom configurations, and source code, are the property of Zyphia or its licensors and are protected under applicable intellectual property law.

You may not reproduce, redistribute, or create derivative works from our content without prior written consent, except for brief quotation with attribution for non-commercial, informational purposes.

Content you submit through the Server or associated channels, such as chat messages, faction names, and other in-game text, remains your responsibility. By submitting it, you grant us a non-exclusive, royalty-free license to store, display, and use it as needed to operate and moderate the Server. You must not submit content that is unlawful, infringing, or in violation of the server rules.

The Server and Site rely on and link to third-party services, including Tebex for purchases and Discord for community communication. Your use of those services is governed by their own terms and privacy policies. We do not control and are not responsible for third-party services, and a link or integration does not constitute an endorsement.

The Server and Site are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Server or Site will be uninterrupted, secure, error-free, or free of data loss, and we may modify, suspend, or discontinue any part of them at any time.

To the fullest extent permitted by applicable law, Zyphia shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, progress, virtual items, or profits, arising out of or related to your use of or inability to use the Server or Site, even if advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability for any claim arising from these Terms or your use of the Server or Site is limited to the amount you paid to us in the ninety (90) days preceding the event giving rise to the claim, or one hundred dollars ($100.00), whichever is greater.

You agree to indemnify and hold harmless Zyphia and its staff from any claims, damages, liabilities, and expenses arising out of your use of the Server or Site, your violation of these Terms or the server rules, or your infringement of the rights of any third party.

These Terms are governed by and construed in accordance with the laws applicable to Zyphia's operations, without regard to conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the Server or Site will be resolved on an individual basis before the appropriate courts of competent jurisdiction.

We may modify these Terms at any time. The effective date at the top of this page will reflect the most recent revision. Your continued use of the Server or Site after any modification constitutes acceptance of the revised Terms.
